As reported by Global Arbitration Review, on August 6 2019 an ICSID tribunal chaired by Yves Derains unanimously dismissed investor’s claims against Italy in the investment arbitration proceeding between Belenergia S.A. and the Italian Republic.
The arbitration, in which Giacomo Rojas Elgueta acted as legal expert for the Italian Republic, was one of the Energy Charter Treaty proceedings brought against Italy following a 2014 regulatory change in the renewable energy sector.
